Cease and Desist

Giacom have issued a cease and desist and it appears they, like their top exec, don’t like truthful criticism of their company and their people.

The Offending Website, taken as a whole, is false, misleading, defamatory and unlawful. It has caused, or is likely to cause, serious harm to the reputation of Giacom. The seriousness of that harm is aggravated by the fact that the Offending Website is plainly directed at existing and prospective customers, partners, suppliers, employees and other stakeholders of Giacom, is designed to discourage third parties from dealing with Giacom

To backup their position they’ve included screen shots of this very site but failed to address specific points.

By way of example, the Offending Website makes or repeats allegations to the effect that Giacom lies to partners, fails to honour agreements, damages partner reputations, discloses partner data, overcharges partners, suffers repeated service downtime, mismanages its network, treats staff improperly, and should be avoided as a commercial partner. These allegations are presented as statements of fact and/or carry factual imputations. They are untrue and defamatory. Given the nature, volume, presentation and purpose of the Offending Website, removal of individual passages would not be sufficient to remedy the ongoing harm.

What Giacom fail to understand is that all claims written are backed up by evidence. These are not just things plucked out of thin air. They are backed up by emails, letters, phone call and Teams recordings and Linked In messages. From customers and staff alike.

Giacom have been invited to specifically set out exact statements they have issue with as yet unaswered.

Customers of Giacom should no doubt see the irony of them only being concerned about their reputation because when it comes down to the reputation of your own customers, there is no equal importance.
